If Biden Cancels Student Loans, It Could Look Like This

If President Joe Biden cancels student loan, this is what the student loan termination could look like.

Here’s what you need to know.

Biden has asked the U.S. Department of Education to conduct a legal review of the president’s authority to cancel student loan debt. The outcome of this review, which has not yet been finalized but is expected in a few weeks, could influence Biden’s decision on whether a major student loan waiver will be waived. There are two main ways to get student loans out. Here’s what might be included in this recommendation, and what it means for your student loans:

Who Can Qualify for Student Loan Cancellation?

Despite general requests to “cancel all student loans”, not everyone gets a loan for the student loan. This may come as a surprise, but there is no general proposal to cancel student loans for every borrower. As with stimulus checks, there will likely be restrictions on student loan eligibility. Various proposals have been made that could determine who is eligible for student loan cancellation, although these could change as both Biden and Congress consider the various political, legal, and political implications of large-scale student loan forgiveness.

Which student loans could be canceled

Are you eligible for student loan waiver? When Biden and Congress talk about “cancel student loans” they are referring to federal student loans. Federal student loans account for more than 90% of outstanding student loan debt. More specifically, they relate to student loans owned by the U.S. Department of Education. In contrast, private student loans can be owned by lenders, banks, or third party investors and are therefore not federally owned. The leading student loan waiver proposal in Congress put forward by Senate Majority Leader Chuck Schumer (D-NY) and Senator Elizabeth Warren (D-MA) applies only to federal student loans. Could Biden decide to cancel both private and government student loan debt? Yes. However, there is no indication that he is considering canceling the student loan over and above the state student loans. The next question is whether FFELP loans and Perkins loans could also be canceled. Most of these student loans are not owned by the US Department of Education. Most FFELP loans are owned by financial institutions and third party investors, while Perkins loans are made by colleges and universities. If you have an FFELP or Perkins loan, you can group these student loans into a direct consolidation loan. Please contact your student loan service provider for more information. A direct consolidation loan would convert those student loans into a direct student loan which would be the most likely type of federal student loan to be given.

Cancellation of the student loan could be limited by income

Opponents of student loan termination have argued that widespread student loan waiver with no income-related cap could benefit wealthy student loan borrowers without exception. This is another reason why not everyone cancels their student loan. For example, Schumer and Warren want to limit student loan issuance to borrowers with an annual income of up to $ 125,000. Biden wants three ways to cancel the student loan and has supported the same income threshold ($ 125,000) for other types of student loan forgiveness. However, Biden has not publicly endorsed any particular income threshold for the extensive granting of student loans. The next question will be whether this income limit will be lowered. For example, the stimulus checks in the latest stimulus package had an income threshold of $ 75,000 for each individual, which is $ 50,000 less than the proposed income threshold in the Schumer and Warren bill.

What is the student loan cancellation rate?

Some congressmen, like Senator Bernie Sanders (I-VT), have called for the student loan to be canceled entirely. This means that all $ 1.7 trillion of private and government student loan debt would be canceled. However, that won’t happen. The President does not support it, neither does Schumer or the Speaker of the House of Representatives Nancy Pelosi (D-CA). While Schumer and Warren support canceling student loans up to $ 50,000, there is no indication that Biden is actively considering student loan issuance of $ 50,000. Biden has supported the immediate cancellation of $ 10,000 student loans and has urged Congress to cancel the student loan debt. Biden said he doesn’t believe the president has unilateral powers to enact wide-ranging student loan remission by executive order.

Cancellation of student loan: the next steps

The Department of Education memo will also address other aspects of student loan waiver, including the president’s legal power to unilaterally terminate student loans without further approval from Congress. The memo could also include recommendations on student loan cancellation, alternative ways to facilitate student loan relief in addition to student loan cancellation, and arguments for and against student loan cancellation. If Biden cancels student loans by order of the executive, a $ 10,000 student loan forgiveness is assumed based on his public statements as a presidential candidate and base-case president. Alternatively, there could be an income-based cancellation of the $ 10,000 student loan. If it has no legal authority, Congress would have to pass laws. There are currently not enough votes to support a bill with up to $ 50,000 in student loans that lawmakers would have to propose an amended bill.

There is no guarantee that there will be a full cancellation of the student loan. If so, you cannot qualify. So if you are not getting student loan forgiveness, make sure you have a student loan game plan. Here are some possible options to consider in order to save money:
